The perplexities of modern international law

Rosenne, Shabtai
Product Description This is a revised and updated version of the General Course on Public International Law. The century just ended has seen the greatest transformation of human society in all of recorded history. With that, the pattern of international relations and international law has also witnessed radical transformation. The whole system that existed one hundred years ago has been swept away, but the new system is not yet firmly established and in place. Every ‘precedent’, whether legal or other, must first be placed in its historical and temporal context before we can see if it is applicable in new circumstances and the historical evolution of any notion or concept is important for an understanding of its current implications. Through a close linkage between law and history, the author takes us through the evolution of international law to where it stands today. Review ' In these lectures, Rosenne has dealt with theimportant and structural issues of the system ofinternational law in an enviable manner. Onecan say that Rosenne's General Course is ajourney of exploration, displaying not only greatlearning but also wisdom. We have a great dealto be grateful to him for.' Sienho Yee, Chinese JIL, 2006. ' This review is testimony to the possibilities and the limits of that grand modern project called international law. Rosenne and I share an educational and disciplinary background, a vocabulary, the legacies of European (and specifically British) colonialism, and a place as inhabitants of modern international institutional life. Despite this shared inheritance, reading this book at times produced for me uncomfortable moments of disappointment, disagreement, bewilderment, and failed communication. Yet these existed alongside pleasurable moments of engagement, understanding, and solidarity. Can law promise, and should we expect, anything more?' Anne Orford in American Journal of International Law, 2005. ' Professor Rosenne herein exposes a rich field of valuable gems, which glitter because of their sparkling contribution to a realistic view of what modern history has done to alter norms thought sacrosanct since the dawn of the modern system of International Law. [...] Any library that touts itself as a resource for International Law materials would be incomplete without this authoritative restatement penned by one of the grand masters in the field.' ASIL Newsletter UN21 Interest Group, 2004. Winner of The Hague Prize for International Law 2004. About the Author Shabtai Rosenne is the author of The Law and Practice of the International Court of Justice, now in its third edition; The World Court: What It is and how It works (sixth edition) and General Editor of the authoritative United Nations Convention on the Law of the Sea 1982: A Commentary.

Legitimacy and commitment in the military

Thomas C. Wyatt,Reuven Gal
An innovative addition to the literature of military studies, this exploration of the issues of legitimacy and commitment in the military focuses on the contemporary military situation, critically analyzing current fault lines and future trends in this area. The editors, Thomas C. Wyatt and Reuven Gal, contend that post-World War II wars are different from the two wars preceding them, that the nontraditional wars in Algeria, Vietnam, Pakistan, Lebanon, the Falkland Islands, and Grenada, among others, can be characterized by issues of national concensus and home support, political debates, moral argumentations and counterargumentations, demonstrations and alienation, and conscientious objectors. In such wars, weapons systems, training, and tactics become secondary to issues of legitimacy and commitment. Military organizations, too, are different in that they are now prepared not only for wars but also for peace and peace-keeping missions that consist of police-type or constabulary tasks. Also, the volunteer army has largely replaced the army composed mainly of conscripts, and these better-educated soldiers are different in that they will examine carefully the sources of military legitimation before furnishing the unconditional commitment that is the backbone of the military fighting spirit. The volume's eleven chapters were contributed by an international group of leading behavioral scientists who write from the perspectives of a wide scope of disciplines, including psychology, sociology, history, philosophy, anthropology, and military studies. The work is divided into three main parts that focus on some of the theoretical puzzles inherent in the combination of military ethics and moral values; assess sources of legitimacy and commitment; and detail the manifestation and measurement of commitment and legitimacy in a variety of nations and organizations. The subjects of conscientious objection, educational benefits, the Army Reserve, and the Vietnamese, U.S., Soviet, and Israeli armies are a few of the intriguing topics scrutinized here. As a whole, Legitimacy and Commitment in the Military provides an essential collection for the military student, the scholar, the soldier, and military professionals who aspire to leadership. The various individual chapters offer unique insights for students and researchers in the fields of ethics, history, anthropology, and the behavioral sciences.

Compassionate education: a prolegomena for radical schooling

Lampert, Khen
This book criticizes sharply the way in which schools create, exacerbate and ignore the distress of children, when in fact the place that is supposed to provide a humane response to that very distress. Taking a broad critical and interdisciplinary approach (philosophical, sociological, psychological and educational), the book points out the organizational, psychological and functional difficulties of today's public school, which prevent the adults working there from sensing taking responsibility for and acting to alleviate the distress of children.

He and his colleagues forged and sustained a new understanding of the purpose and possibilities of the subject English within the school curriculum. The gate of heaven: the story of Congregation Shaar Hashomayim of Montreal, 1846-1996

Shuchat, Wilfred.
Rabbi Shuchat tells of the emergence of Shaar Hashomayim as a congregation separate from the Spanish and Portuguese fold, the generation-long tension between the two congregations, and the rebellion that produced the Temple Emanuel. He describes the role of the Canadian government in the ups and downs of Jewish immigration and details the effects of world-wide anti-Semitism on the local community, as well as the struggle for Jewish educational rights that ultimately produced a real public school system in the province of Quebec. The student protest that almost paralysed the Passover festival and the day school crisis that almost split the congregation are recounted in detail, and the Pavilion of Judaism at Expo '67 is described. Weaving together individual stories and the history of the Shaar, Rabbi Shuchat demonstrates how the turbulence of the nineteenth century produced a twentieth-century Shaar and Montreal Jewish community that are second to none in tolerance and creativity.

Labor and the Employer

Samuel Gompers
Excerpt from Labor and the Employer Since the first volume of this compilation was prepared the industrial situation in the United States has grown more acute and the essential labor issues more sharply defined. During the war, workingmen and employers gave to the Government a loyal and united service, in shop and mine no less than on the field, which promised to lay broad foundations for an era of good-will and cooperation during the reconstruction and in peace-time relations for years to come. But in the period since the end of hostilities three factors especially have conspired to disappoint or at least postpone these hopes. There has been a continuing pressure of high living costs, where relief was anticipated; an unwillingness of various employing interests to extend to labor in industrial dealings the recognition accorded, at least tacitly, in the many plans and programs jointly undertaken and worked out during the war, and, on the other side, a renewed, widespread and determined effort of radical elements to capitalize the ideas and emotions of the war upheaval for revolutionary propaganda. All three of these factors have affected the mood of labor in many quarters, and lent new force for the time being to the "boring from within" tactics of socialist and syndicalist factions in the trade-union movement. In such a situation, the views of the chief authoritative exponent of American trade-unionism on the outstanding topics discussed in the present volume are at this moment directly to the point. The issues are literally those around which industrial unrest for the most part centers. Thereby the volume adds an immediate practical interest to the permanent educational value which thoughtful students of the unfolding movements of the time will readily see in it. The first volume, Labor and the Common Welfare, embodies Mr. Gompers' interpretation of labor's relation to the well-being of the whole community. The present volume goes to the heart of the ever-present concrete problems of employment relations. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. A conception of teaching

Gage, Nathaniel L.
The Publisher notes with profound regret that Nathaniel "Nate" Lees Gage, a Stanford professor emeritus of education who has been called the "father of modern research on teaching," died Aug. 17 at Stanford Hospital. He was 91. After everything else has been done and provided—the money raised; the schools erected; the curricula developed; the administrators, supervisors, and teachers trained; the parents and other citizens consulted—we come to teaching, where all of it makes contact with students, and the teacher influences students’ knowledge, understanding, appreciations, and attitudes in what we hope will be desirable ways. Teaching is well-nigh the point of the whole educational enterprise and establishment aimed at producing student learning. The literature of the behavioral and social sciences is full of theory and research on learning and memory. Teaching is comparatively a stepchild, neglected by those who have built a formidable body of theories of learning and memory. However, teaching is where learning and memory theory should pay off. A Conception of Teaching dedicates a chapter to each of the following important components: the need for a theory; the possibility of a theory; the evolution of a paradigm for the study of teaching; a conception of the process of teaching; a conception of the content of teaching; a conception of students’ cognitive capabilities and motivations; a conception of classroom management; and the integration of these conceptions. Written in a highly accessible style, while maintaining a base in research, Dr. Nathaniel L. Gage presents A Conception of Teaching with clarity and well situated within current educational debates.

The Jerusalem Review, Vol. 8

Gabriel Moked
The Jerusalem Review is published in Israel, and is meant to be distributed all over the world. It includes translations from Hebrew literature ancient and modern; contributions by Jewish writers in the Diaspora; essays on various aspects of Judaism, Israel, the Middle East, and related topics, and a section devoted to the visual arts in Israel. It also seeks to establish a genuine dialogue with non-Jewish authors and intellectuals. We wish to exhibit both the pluralism and the unique character of spiritual, cultural, artistic, and educational trends existing in contemporary Israel. Despite the limited number of Hebrew speakers and readers, Hebrew is one of the classical languages of West and East alike, and perhaps the only classical language still spoken today. Its vitality and richness are also manifest in the achievements of contemporary Israeli literature. The Jerusalem Review seeks to transcend the barrier of language and to cultivate a joint Israeli-Diaspora forum based on mutual exploration of cultural issues and reflection on many dimensions of Jewish heritage. In addition, we intend to reach the non-Jewish intellectual and enlightened media ambiences, and initiate a dialogue with Palestinian, Arab and Muslim writers and academy elites from a standpoint of mutual respect.
