The Law of the United Nations A Critical Analysis of Its Fundamental Problems (Classic Reprint)

Hans Kelsen
Excerpt from The Law of the United Nations: A Critical Analysis of Its Fundamental Problems T1115 book is a juristic - not a political - approach to the problems of the United Nations. It deals with the law of the Organisation, not with its actual or desired role in the international play of powers. Separation of law from politics in the presentation of national or international problems is possible in so far as law is not an end in itself, but a means or, what amounts to the same, a specific social technique for the achievement of ends determined by politics. It stands to reason that in dealing with legal questions the elimination of the political issues involved is always relative, never absolute. In a merely juristic inquiry the political ends of the law-maker, in so far as they are ascertainable in an objective way, are taken for granted, and, hence, not subjected to a criticism, except to the degree that it may properly be restricted to the law as a means to these ends. Juristic in contradistinction to political has the connotation of technical.' It is not superfluous to remind the lawyer that as a jurist he is but a technician whose most important task is to assist the law-maker in the adequate formulation of the legal norms. Design for liberty: private property, public administration, and the rule of law

Epstein, Richard A.
Following a vast expansion in the twentieth century, government is beginning to creak at the joints under its enormous weight. The signs are clear: a bloated civil service, low approval ratings for Congress and the President, increasing federal-state conflict, rampant distrust of politicians and government officials, record state deficits, and major unrest among public employees. In this compact, clearly written book, the noted legal scholar Richard Epstein advocates a much smaller federal government, arguing that our over-regulated state allows too much discretion on the part of regulators, which results in arbitrary, unfair decisions, rent-seeking, and other abuses. Epstein bases his classical liberalism on the twin pillars of the rule of law and of private contracts and property rights—an overarching structure that allows private property to keep its form regardless of changes in population, tastes, technology, and wealth. This structure also makes possible a restrained public administration to implement limited objectives. Government continues to play a key role as night-watchman, but with the added flexibility in revenues and expenditures to attend to national defense and infrastructure formation. Although no legal system can eliminate the need for discretion in the management of both private and public affairs, predictable laws can cabin the zone of discretion and permit arbitrary decisions to be challenged. Joining a set of strong property rights with sound but limited public administration could strengthen the rule of law, with its virtues of neutrality, generality, clarity, consistency, and forward-lookingness, and reverse the contempt and cynicism that have overcome us.

Chernobyl: Law and Communication Transboundary Nuclear Air Pollution - The Legal Materials

Philippe J. Sands
The 1986 accident at the Chernobyl plant highlighted the need to examine and clarify the obligations imposed by international law on States engaged in nuclear and other ultra-hazardous activites. This volume brings together in full the texts of the most important materials necessary for a comprehensive examination of the international law and communication issues arising from nuclear and other accidents with transboundary effects. The texts reproduced include multilateral and bilateral treaties, non-binding acts of international organizations and private associations of scholars, and national legislation. Their chronological presentation reflects the development of the law up to and including the 1986 IAEA Conventions on Early Notification and Assistance and the 1987 Resolution of the Institut de Droit International on Transboundary Air Pollution. Each text is introduced by a Note summarizing its background and main provisions, and is accompanied by a select bibliography. The signatories and parties to the treaties are set out in full. This work is a publication of The Annenberg Washington Program in Communications Policy Studies of Northwestern University and the Research Centre for International Law, University of Cambridge.

Political justice: the use of legal procedure for political ends

Kirchheimer, Otto
How have regimes used the agencies of criminal justice for their own purposes? What characterizes the linkage of politics and justice? Drawing on a wealth of foreign and domestic source material, Otto Kirchheimer examines systematically the structure of state protection, the nature of a strictly political trial, including the trial by fiat of the successor regime, and the forms of legal repression that states have used against political organizations. He analyzes the Nuremberg trials, the Communist purge trials, and a number of Smith Act trials. In two highly original chapters he also explores the political and judicial nature of asylum and clemency. This study of the uneasy balance between abstract justice and political expediency is a contribution to constitutional and criminal law, political science, and social psychology.Originally published in 1961.The Princeton Legacy Library uses the latest print-on-demand technology to again make available previously out-of-print books from the distinguished backlist of Princeton University Press.
